Terms of Service

Plain English summary: You own your content. We host it. Be professional, don't abuse the platform, and keep billing current. Paid plan changes follow your billing cycle; cancellation keeps paid access through period end. If the next plan cannot hold your current usage, Recovery Manager gives you a 7-day window to resolve excess work before permanent cleanup.

1. Acceptance of terms

By creating an account on Folvi ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. Your continued use of Folvi constitutes ongoing acceptance of these terms.

2. Description of service

Folvi is a portfolio platform designed for instructional designers and L&D professionals. It provides tools to create and share a public portfolio page, showcase projects, upload or link to eLearning content, and communicate with visitors via private messaging.

3. Your account

You are responsible for maintaining the confidentiality of your account credentials and for activity that occurs under your account. Folvi uses Supabase as part of its authentication and account-data infrastructure. You must be at least 16 years of age to create an account.

4. Acceptable use

You agree not to use Folvi to:

  • Upload or share content that infringes on intellectual property rights you do not own
  • Upload malware, viruses, or malicious code (including in SCORM packages)
  • Impersonate other individuals or organisations
  • Harass, threaten, or abuse other users
  • Attempt to gain unauthorised access to the service or other users' data
  • Use the service for any unlawful purpose

Folvi reserves the right to suspend or terminate accounts that violate these terms at its sole discretion.

5. Content ownership

You retain full ownership of the content you upload to Folvi (portfolio text, project descriptions, uploaded files). By uploading content, you grant Folvi a non-exclusive, worldwide licence to store, display, and serve that content solely for the purpose of operating the Service. Folvi does not claim ownership of your work.

6. Uploaded files and SCORM

You are solely responsible for the files you upload to Folvi. Do not upload files that you do not have the right to share publicly. SCORM packages you upload may be served in-browser to visitors of your public portfolio. Ensure you have appropriate licences for any content within your SCORM packages.

7. Plans, billing, and refunds

Folvi offers the following plans (prices vary by region based on purchasing power parity):

  • Free — 5 active projects, 200 MB Folvi storage, no charge
  • Plus — 25 active projects, 500 MB Folvi storage
  • Pro — 75 active projects, 2 GB Folvi storage

Paid plans are billed via Polar using Folvi's current regional pricing and are available with monthly or annual billing. A paid subscription renews according to the billing period you select unless you cancel or schedule a plan change from Account → Billing.

Cancellation: When you cancel a paid plan, paid access remains active through the end of the current paid period. While that cancellation is still scheduled and paid access has not ended, you can reactivate the same plan. After the paid period ends, Free-plan limits apply. If your current usage exceeds the destination plan's limits, Recovery Manager guides the required choices and keeps excess recovery-owned work in a 7-day recovery window before permanent cleanup.

Refunds: Subscription payments are generally non-refundable once charged, except where a refund is required by applicable law, granted by Polar under its buyer or Merchant-of-Record policies, or approved by Folvi or Polar in circumstances such as duplicate or erroneous charges or a material failure by Folvi to provide the paid service. Approved refunds are processed through Polar. Cancelling a subscription stops future renewals but does not by itself refund the current paid period.

8. Regional pricing

Folvi displays pricing in your local currency based on geographic region. Attempting to circumvent regional pricing by using a VPN, proxy, or other IP spoofing methods is prohibited and violates these terms. Folvi reserves the right to suspend accounts engaged in regional pricing circumvention.

9. Password protection

Users on Plus and Pro plans may password-protect their projects. Folvi uses bcrypt hashing and does not retain plaintext passwords. You can change or remove project passwords anytime directly in the project editor without needing the old password.

10. Service availability

Folvi aims for high availability but does not guarantee uninterrupted access. The Service is provided "as is" and "as available." Folvi is not liable for any loss or damage caused by service interruptions.

11. Limitation of liability

To the maximum extent permitted by applicable law, Folvi shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill.

12. Termination

You may request account deletion at any time from Account → Data & privacy. Folvi may suspend or terminate access for violations of these terms. User-requested deletion is processed through Folvi's account-erasure workflow; Folvi does not promise a universal 30-day deletion period. Any limited retention after erasure is governed by the Privacy Policy and applicable law.

13. Account closure and inactivity

Folvi does not currently delete Free accounts solely because they have been inactive for three months. You may request account deletion from Account → Data & privacy. Any future inactivity-based deletion policy will be reflected in the applicable terms and privacy notice and applied with any notice required by law.

14. Changes to these terms

We may revise these Terms as Folvi, our providers, or applicable legal requirements change. Material changes may be communicated by email, in-product notice, or another reasonable method where appropriate. Where applicable law requires advance notice, consent, or another step before a change takes effect, Folvi will follow that requirement. Otherwise, continued use after the stated effective date constitutes acceptance to the extent permitted by law.

15. User content and grievance compliance

Folvi hosts and transmits content supplied by users. To the extent Folvi acts as an intermediary for that content under the Information Technology Act, 2000 and applicable rules, Folvi follows the due-diligence, grievance, and lawful-removal obligations that apply to the Service.

16. Content removal and takedown procedures

Content grievances, copyright or intellectual-property complaints, impersonation reports, and other unlawful-content complaints may be sent to legal@folvi.org. Where available, the public profile reporting control is an additional path for profile-level reports.

Where the intermediary grievance mechanism under applicable Indian law applies, Folvi acknowledges a grievance within 24 hours and resolves a general grievance within 7 days. Faster statutory periods apply to specified categories, including a 36-hour period for qualifying removal requests and a 2-hour action period for complaints covered by Rule 3(2)(b).

A user whose content is affected may respond with supporting evidence. Folvi does not promise automatic restoration after a response; further action depends on applicable law, the evidence, these Terms, and any relevant court or government direction.

17. International data processing

Folvi relies on service providers that may store or process data in India and other countries. Use of Folvi does not guarantee India-only data residency.

International processing and transfers are handled subject to applicable law and are described in more detail in the Privacy Policy. Provider locations and subprocessors may change as Folvi's infrastructure evolves.

18. Dispute resolution and arbitration

If you have a dispute with Folvi, you are encouraged to contact legal@folvi.org with enough information for the parties to attempt an informal resolution. This informal step does not shorten any statutory limitation period or extinguish any right or remedy available under applicable law.

If a dispute is not resolved informally and is legally capable of being resolved by arbitration, either party may invoke arbitration under the Arbitration and Conciliation Act, 1996. The arbitration will be conducted by a sole independent and impartial arbitrator mutually appointed by the parties; if the parties cannot agree on the appointment, the appointment process under applicable law will govern. The seat and legal place of arbitration will be Bengaluru, Karnataka.

Arbitration costs and any allocation of costs will be determined in accordance with applicable law and the orders of the arbitral tribunal or competent court. These Terms do not require equal cost-sharing regardless of outcome.

Nothing in this section prevents either party from seeking interim or injunctive relief where permitted by law, or limits any non-waivable statutory remedy. Where consumer-protection law provides an eligible consumer with a special forum or remedy, this arbitration clause does not remove that remedy.

19. Taxes, billing, and Merchant of Record

Paid Folvi subscriptions are purchased through Polar. For transactions processed through Polar, Polar acts as the Merchant of Record and reseller for the customer-facing sale and is responsible for calculating, collecting, and remitting applicable transaction taxes, such as VAT, GST, or sales tax, in accordance with the customer's location, tax status, and applicable law.

Any applicable transaction tax may be included in the displayed price or added at checkout depending on the jurisdiction and checkout tax treatment. The final amount, currency, and tax breakdown presented by Polar at checkout and in the resulting order documentation govern the transaction.

Invoices and receipts for Polar-processed purchases are generated by Polar. Where available, Folvi's Billing page provides access to those Polar order and invoice records. You remain responsible for any separate tax, registration, reporting, input-credit, or reverse-charge obligation that applicable law specifically imposes on you; these Terms do not state that reverse charge automatically applies to an Indian business purchase.

20. Third-party services disclaimer

Folvi uses the following critical third-party services: Polar (payments), Supabase (database and authentication), Resend (email), Vercel (hosting), and Cloudflare (DNS, CDN, and R2 storage). If you choose to connect external storage, Folvi also integrates with Google Drive, Dropbox, and Microsoft OneDrive. Each provider has its own terms of service and privacy policy.

Folvi is not liable for any downtime, data loss, or service interruptions caused by these third parties, including payment processing failures, authentication outages, email delivery issues, hosting interruptions, or storage/CDN outages. You are encouraged to review each service provider's terms and privacy policy independently.

Folvi relies on these providers to operate parts of the Service. Connected external accounts remain subject to your existing relationship with the applicable provider.

21. Security practices and incident handling

Folvi uses technical and organisational measures intended to protect the Service and user data. Certain sensitive application fields, including connected-app credentials, are encrypted at the application layer using AES-256-GCM. Passwords used to protect individual Folvi projects are hashed using bcrypt and are not retained in plaintext. Folvi also relies on its infrastructure providers for security controls that apply to the systems they operate.

If you discover a security vulnerability in Folvi, please report it responsibly to security@folvi.org rather than disclosing exploit details publicly. Folvi reviews security reports and prioritises remediation based on the nature, severity, and practical impact of the issue. Unless separately agreed in writing, Folvi does not promise a fixed response or patch-release time.

If Folvi becomes aware of a security incident involving personal data, Folvi will investigate and take appropriate containment and remediation steps and will provide notices to affected users, regulators, or other authorities when and within the period required by applicable law. Notification requirements vary by incident and jurisdiction; these Terms do not create a universal 72-hour notification period. No system can be guaranteed absolutely secure.

22. Events beyond reasonable control

To the extent permitted by applicable law, Folvi is not responsible for delay or failure to perform an obligation to the extent that the delay or failure is caused by an event beyond Folvi's reasonable control that materially prevents or delays performance, such as a natural disaster, pandemic, war, government action, widespread infrastructure or network outage, or major cyber attack. This clause applies only to the impact actually caused by the event and does not excuse obligations that remain reasonably performable.

Folvi does not promise a fixed force-majeure notice period or an automatic charge-free suspension. If an event beyond Folvi's reasonable control materially prevents access to a paid service, any cancellation, refund, credit, or other billing remedy will be handled under Section 7, Polar's applicable buyer or Merchant-of-Record policies, and applicable law. Nothing in this section limits any non-waivable statutory right or remedy.

23. Accessibility

Folvi aims to make the Service accessible to people with disabilities and uses WCAG 2.2 Level AA as a reference target for its accessibility work, alongside accessibility requirements that apply under applicable law. This is an accessibility target, not a representation that every Folvi page, feature, or user-provided item fully conforms to WCAG or has been independently certified.

24. Governing law

These Terms are governed by the laws of India. Disputes are addressed under Section 18, subject to any non-waivable statutory rights, remedies, forums, or jurisdiction that applicable law preserves. Where arbitration under Section 18 applies, Bengaluru, Karnataka is the agreed seat and legal place of arbitration.
