Plain English summary: Report copyright, impersonation, illegal-content, or other content grievances to Folvi's Grievance Officer at legal@folvi.org. Folvi follows the response and removal timelines required by the law that applies to each complaint.

1. Overview

Folvi hosts and serves portfolio content created or supplied by users. This policy explains how to report copyright or intellectual-property concerns, impersonation, illegal content, and other grievances relating to content or computer resources made available through Folvi.

Folvi reviews complaints under its Terms, applicable Indian law, and any other law that applies to the particular complaint. Different statutory procedures may apply depending on the nature of the content, the rights involved, and the jurisdiction.

You may use this address for content grievances, copyright or intellectual-property complaints, requests concerning unlawful content, and responses to a Folvi content action. Where a public portfolio offers a Report this profile control, you may also use that control for profile-level reports such as impersonation, inappropriate content, or spam.

Please include enough information for Folvi to identify the content and understand the basis of your complaint. Where relevant, include:

  • Your name and a working contact email address
  • The exact Folvi profile, project, URL, file, or other content you are reporting
  • The category of complaint and a clear explanation of the issue
  • Supporting screenshots, documents, or other evidence where useful
  • For intellectual-property complaints, identification of the protected work and the basis on which you own or are authorised to enforce the relevant rights

Folvi may request clarification or additional information when reasonably necessary to evaluate a complaint.

3. Copyright and intellectual-property complaints

If you believe Folvi-hosted content infringes copyright or another intellectual-property right, email legal@folvi.org with enough material to identify the protected work, the allegedly infringing Folvi content, and your ownership or authority to act.

Indian copyright law contains different procedures for different forms of infringement. Copyright Rule 75 contains a specific mechanism for transient or incidental storage that can require an undertaking, a court-order process, and temporary access restraint. That mechanism does not automatically apply to every Folvi-hosted upload.

Folvi may remove or disable access where required by applicable law, a court or competent authority, or where the available evidence and Folvi's Terms justify action.

4. Grievance timelines

General grievances: Folvi will acknowledge a grievance within 24 hours and resolve it within 7 days where the grievance mechanism under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 applies.

Faster removal categories: Where those Rules prescribe a 36-hour resolution period for a qualifying removal request, Folvi will apply that shorter period.

Private, sexual, or impersonation content: For a complaint by an individual, or a person acting on their behalf, concerning hosted content that prima facie exposes private areas, shows full or partial nudity or sexual conduct, or constitutes electronic impersonation including artificially morphed imagery, Folvi will take reasonable and practicable measures to remove or disable access within 2 hours where Rule 3(2)(b) applies.

Other statutory notices, court orders, or directions from competent authorities may carry different timelines. Folvi follows the timeline required by the law or order that applies to the particular matter.

5. Responding to a content action

If your content is removed, disabled, restricted, or otherwise affected by a complaint and you believe the action was incorrect, you may respond to legal@folvi.org. Identify the affected content, explain why you believe the action should be reconsidered, and provide supporting evidence of ownership, licence, consent, lawful use, or other relevant rights.

A response does not trigger automatic restoration. Folvi may restore, continue to restrict, or take another action after considering the evidence, applicable law, its Terms, and any relevant court or government direction.

6. Repeat infringement and abusive complaints

Folvi does not apply an automatic three-notice rule. Repeated or serious infringement, unlawful use, evasion of prior restrictions, or other material violations may lead to content restrictions, suspension, or account termination depending on severity, history, and applicable law.

Folvi may reject complaints that are materially incomplete, knowingly false, abusive, or submitted in bad faith. False statements or misuse of legal complaint procedures may also carry consequences under applicable law.

7. Liability for false claims

If you knowingly misrepresent that content is unlawful or infringing, or knowingly provide false information in response to a content action, you may face consequences under applicable law.

Folvi does not indemnify filers for false, malicious, or frivolous complaints. Make sure your claim is legitimate before submitting.

8. Illegal content

For complaints involving impersonation, non-consensual intimate imagery, threats, unlawful content, or other serious abuse, contact legal@folvi.org and identify the exact content or communication link. Where the profile-level reporting control is available, you may use it as an additional reporting path. If there is an immediate threat to physical safety, contact the appropriate emergency or law-enforcement service in addition to notifying Folvi.

9. Appeals under the IT Rules

Where Rule 3A of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 applies, a person aggrieved by a decision of the Grievance Officer, or whose grievance is not resolved within the applicable period, may appeal to the Grievance Appellate Committee within the period provided by those Rules.
